  2. Definitions
    1. APPLICATION/APP: "Application/App" shall refer to the MDPD platform, i.e. the mobile application or the algorithm created, developed, designed and made available by Kreon.

    2. APPLICATION SERVICES: “Application Services” shall include the MDPD mobile application offered by Kreon, services offered through the mobile application and emails sent by Kreon.

    3. KREON/KREON FINANCE: "Kreon/Kreon Finance" shall mean KREON FINNANCIAL SERVICES LIMITED, a non-banking financial company that provide Services related to MDPD including but not limited to sanctioning, processing, and disbursing the advance wage payments to the User of the Application.

    4. PLATFORM: “Platform” shall mean the MDPD (My Day Pay Day) Application and the Website.

    5. SERVICES: "Services" shall mean any service offered or rendered by Kreon Finance or its affiliates through the Platform.

    6. THIRD-PARTY PLATFORMS: “Third-Party Platforms” shall mean social networking platforms offered by third-party service providers, such as Google, Facebook, LinkedIn and other similar entities which may be integrated with the Platform for registration or sharing purposes.

    7. USER ACCOUNT: "User Account" shall mean the registered account of the User on the Platform for accessing and utilizing the services offered with Kreon for use of the Application and services offered by Kreon.

    8. WEBSITE: "Website" shall refer to www.mdpdapp.com or such other website Kreon notifies for the purposes of this terms.

    9. YOU/YOUR/USER: "You/Your/User" shall mean any person who accesses, downloads, installs, utilizes, or uses the Application or Services offered by Kreon

  3. Scope
    1. This Privacy Policy applies to the User data collected by Kreon for the purpose of providing Services through the Platform, including

    2. Employee Identification and Employment Data: Your name, e-mail address, employment status, salary details, demographic information, and work hours.

    3. KYC Information: Such as AADHAAR card, PAN card, and bank account details for identity verification and compliance with Know Your Customer (KYC) regulations.

    4. Financial Information: Bank account details, credit score data, bank statements, disbursal limits, and repayment dates for managing Earned Wage Access (EWA) services.

    5. Attendance and Work History: Time and attendance data, shift records, and payroll frequency, necessary for calculating the wages you’ve earned and eligible to access.

    6. Location Data: We may collect location information in connection with the application and services provided.

    7. Mobile Device Data: Including information such as device identifiers, browser history, and call logs, when necessary, for fraud prevention and service optimization.

    8. All such information collected is hereinafter referred to as “Personal Information.

  4. Collection Of Data
    1. The Personal Information shall be collected through the mobile application (“Mobile Application Form”) available on the Application or through authorized Third-Party Platforms or directly from your employer in cases involving payroll data, work history, or bank account information.

    2. As part of the Services, you authorize us to import your details and Personal Information , including attendance and payroll data, from Third Party Platforms and employer systems, to calculate and process your wage access.

    3. We also collect from a unique ID from your mobile device for device-specific identification purposes. If you are using an an iPhone, we also collect the Apple-recommended CFUUID (the Core Foundation Universally Unique Identifier)) and you consent to the same by installation or use of the application.

    4. You understand and acknowledge that the Kreon reserves the right to track your location (“Track”) during the provision of the Services, and also in the event that you stop, cease, discontinue to use or avail the Services, through the deletion or uninstallation of the Mobile App or otherwise, till the event that your obligations to pay the Outstanding Amount(s) to Kreon, exist. Deletion, uninstallation, and/or discontinuation of our Services, shall not release you from the responsibility, obligation and liability to repay the Outstanding Amount(s).

  5. User data
    1. We shall use the User data in the following cases:

      1. To provide Earned Wage Access (EWA) services: Including calculating your eligible wages and processing disbursements.

      2. To assess your creditworthiness: We may use your financial and employment data, such as salary details and credit score, to evaluate your eligibility for the service.

      3. To maintain and manage your MDPD User Account: This includes tracking your wage access activity, updating account details, and ensuring the accuracy of your financial and employment information.

      4. To assist with technical difficulties : If you encounter any issues while using the MDPD platform, we may access relevant data to resolve these technical problems.

      5. To manage our relationship with you: For instance, to notify you of any policy updates or changes related to MDPD.

      6. For analytics: We may analyze user data to improve our services, provide insights into user behavior, and refine the MDPD platform.

    2. User -generated content Any content created or submitted by you through the MDPD platform, such as reviews or feedback, is not considered confidential or proprietary. By providing such content, you grant us a non-exclusive, non-revocable, worldwide, royalty-free, perpetual license to use, translate, display, reproduce, modify, distribute, and commercialize your content in any medium, without any payment due to you. You warrant that you have the rights to grant this license.

    3. Legal Basis: We process your information on the following legal basis

      1. Consent: Where you have explicitly given your consent to the processing of your Personal Information for specific purposes (e.g.,subscribing to marketing communications).

      2. Contractual Necessity: When the processing of your Personal Information is necessary for the performance of a contract between you and Kreon (e.g., providing EWA services).

  12. Limitation Of Liability

You agree to indemnify us, our subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees and hold us harmless from and against any claims and demand, including reasonable attorneys’ fees, made by any third party arising out of or relating to: (i) Personal Information and contents that you submit or share through the Platform; (ii) your violation of this Privacy Policy, (iii) or your violation of rights of another Customer(s).

You expressly understand and agree that Kreon shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, information, details or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) unauthorized access to or alteration of your Personal Information.

    1. This Agreement shall be construed and governed by the laws of India and courts of law at Chennai shall have exclusive jurisdiction over such disputes without regard to principles of conflict of laws.
